Background of the Study

Medical negligence laws are essential in ensuring accountability and protecting patient rights within healthcare systems. In Nigeria, the legal framework governing medical negligence is critical for safeguarding patients from harm due to substandard care, as well as protecting healthcare providers from unwarranted claims. Emergency nurses, as frontline healthcare workers, play an essential role in preventing incidents of medical negligence through their adherence to established protocols and standards of care.

Zamfara State Specialist Hospital, located in a region where access to healthcare may be limited and the legal education of healthcare professionals may be underdeveloped, presents an opportunity to assess the knowledge of emergency nurses regarding medical negligence laws. With the growing concerns about patient safety and the increasing number of malpractice claims, this study aims to evaluate the understanding of emergency nurses in Zamfara State Specialist Hospital regarding legal concepts related to medical negligence, the implications of negligence in emergency care, and how their awareness impacts patient care and legal outcomes.

Statement of the Problem

Despite the importance of medical negligence laws in healthcare, the knowledge of emergency nurses regarding these laws is often insufficient, which can lead to increased risk for malpractice claims, poor patient outcomes, and legal consequences. At Zamfara State Specialist Hospital, there is limited research on how well emergency nurses understand and apply medical negligence laws in their practice. This gap in knowledge can compromise the quality of emergency care and the safety of both patients and healthcare workers.

Objectives of the Study

  1. To assess emergency nurses' knowledge of medical negligence laws at Zamfara State Specialist Hospital.
  2. To evaluate how well emergency nurses apply legal concepts related to medical negligence in their daily practice.
  3. To identify gaps in emergency nurses' understanding of medical negligence laws and recommend strategies for improvement.

Research Questions

  1. What is the level of emergency nurses' knowledge of medical negligence laws at Zamfara State Specialist Hospital?
  2. How do emergency nurses at Zamfara State Specialist Hospital apply medical negligence laws in their practice?
  3. What strategies can be implemented to improve emergency nurses' knowledge of medical negligence laws?

Research Hypotheses

  1. Emergency nurses with higher knowledge of medical negligence laws demonstrate a lower likelihood of engaging in practices that lead to legal liability.
  2. There is a significant relationship between emergency nurses' knowledge of medical negligence laws and their compliance with patient safety protocols.
  3. Training and education programs on medical negligence laws will improve emergency nurses' knowledge and reduce the incidence of malpractice in emergency care.

Scope and Limitations of the Study

The study will focus on assessing the knowledge of medical negligence laws among emergency nurses at Zamfara State Specialist Hospital. Limitations include challenges in assessing the depth of nurses' legal knowledge, potential biases in self-reported data, and the influence of regional legal frameworks that may not be universally applicable across Nigeria.

  • Medical Negligence: Failure to provide the standard of care that a reasonably prudent healthcare provider would provide under similar circumstances, resulting in harm to the patient.
  • Emergency Nursing: A specialized area of nursing that focuses on providing immediate care to patients in emergency medical situations.
